Terms and conditions

These terms and conditions (“Terms”) are provided by HBTS Sweden AB (org.no 559339-6558) (“HA-BITS”, “The company”, “we” or “us”) and apply to all orders the customer (you) make via our website (Site). We offer this Site, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 Please read these Terms of Service carefully before accessing or using www.ha-bits.co (the Site) and the services, features, content, applications, or products offered by us and our affiliates (“we”, “us”, “our” or “HA-BITS”) (the “Services”).

Agreeing to the Terms

By ordering products, creating a Subscription and/or creating an Account on our site, you confirm that you have read, understood and agree to be bound by these Terms, including any additional terms and conditions and policies referenced and/or linked herein. If you do not agree to these Terms, you must not order Products or create a Subscription and/or Account.

Some of our Services may be subject to additional terms and conditions specified by us; your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.

Changes in the Terms of Service

We reserve the right to update, change or replace any part of these Terms. It is your responsibility to check this page periodically for changes. When changes are made that are significant, and which changes will affect you, we will send an email informing you of these changes. If we do not get an objection within thirty (30) calendar days after these changes have been communicated, we will assume you have agreed to the changes. Your continued use of or access to the website (e.g. continuing to order products or changing your subscription) following the communication of any changes constitutes acceptance of those changes. Any new features or tools which are added to the Site shall also be subject to these Terms. The latest version of these Terms will always be available on the site.

Third party service providers

Our store is hosted by Elementor cloud and Woocommerce. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

Our payment options are provided by Klarna. Read more under Products & Services > Payment options.

Products & Services

Ordering products

We ask you to order the Products in accordance with the instructions on the Site.

You will need to provide mandatory information in order for us to fulfil your order. You are solely responsible for ensuring that the information provided is correct and are obliged to notify us without delay if it changes.

We will confirm an order by sending an automatic email confirmation to the e-mail address provided by you. You must verify that the content of the order stated in the email confirmation corresponds with the order made by you. If we are unable to confirm your order, we will inform you of this in writing and will not charge you anything. You can withdraw your order until it has been confirmed, and you have the right to be refunded for any payments made to us due to a withdrawn order.

The inclusion of any Products on the Site at a particular time does not imply or warrant that these Products will be available at any time. We reserve the right to change or remove Products and services from our offerings at any time, without prior notice to you as a customer. As the colour settings of the device you are using may affect the colours of the images on the Site, we do not guarantee that the colours of the pictures of Products on the Site will be true to life. We reserve the right to any delivery delays and final sales. Furthermore, we reserve the right to make technical errors, printing errors and typos.

Subscription service

When you order the start kit, you enter a Subscription of toothpaste tablets. This Subscription is offered with a delivery frequency of every two months or every four months. A new order is automatically created once per the decided interval.

You can change your Subscription intervals and products and/or pause or cancel the Subscription in your Account, or by contacting us at [email protected]  (see Contact Information). Any changes must be done at least 48 hours before the next order interval starts. If the Subscription has not been terminated or changed in time, it will automatically be renewed. If your purchase is refused by our payment provider on five (5) repeated payment occasions, your subscription will be paused automatically.

Creating an Account

An Account is created automatically when creating a subscription. You are not allowed to transfer the Account to others, and you may only sign up for one (1) Account. From your Account, you can see previous orders, adjust, pause and cancel your subscription, update your contact information as well as communication settings.

Price information

You must pay all applicable charges as described on the Site for the Products that you have selected. The prices for the Products are shown on the Site and include any explicitly set out relevant delivery costs, value-added tax (VAT) or other fees and taxes (as applicable). The price of the Products provided to you will be the price indicated on the order pages when you placed your order.

We reserve the right to change the prices for the Products on the Site. However, for orders placed before a change of prices on the Site, the prices stated in the order confirmation will be the applicable price on that specific order. By continuing to order the Products after the price changes come into effect, you agree to be bound by the new prices. We strive to keep price information displayed on the Site current and correct, but do not guarantee and are not responsible for the accuracy of the information.

Payment options

The payment solutions available to you are visible in the checkout process and could differ from each specific market.

We use Klarna as a third-party payment provider, and therefore, Klarna’s terms and conditions will apply. You may be requested to identify yourself and credit reports may be pursued by the third-party processor/provider. Due to our use of a third-party payment provider, we will not have access to or store any payment information.

You agree to pay within the set time for the payment method you choose. We have the right to close down your Account and/or stop the shipment of Products until you have paid for all the charges incurred by you. Payment after the due date can entail late payment fees and interest according to the terms of the payment provider.

You agree that we may charge payments for automated Subscription orders without further approval until you terminate or pause your Subscription agreement. The prices for these orders will correspond to the prices stated on the Website at the time you entered into agreement with us.

Delivery

Delivery is currently only available to customers with a delivery address in Sweden.

During the order process, we will let you know when your order has been received and when Products have been shipped. On automated Subscription renewal orders, we will confirm when the renewal order has been received. Delivery is made through the standard postal service in each market. The expected delivery time is specified during the order process. During high season and sales, the delivery can take longer.

If a Product runs out of stock, we reserve the right not to deliver that Product within the specified delivery time or cancel the order. If you have already ordered the Product that is out of stock, we will offer you a refund.

Delivery costs

We offer you free shipping within Sweden. Some alternatives may involve a freight cost which in such a case is clearly stated when ordering.

Unredeemed packages at pick-up points

Unredeemed packages are charged a fee of 150 SEK o cover the costs that an uncollected package entails for us. Your package will normally be at the pick-up point for 14 days before it is sent back to our warehouse.

Damaged goods

It is important to always inspect the package on arrival for any transportation damages.

In case you receive goods that have been damaged during transport, you need to notify us immediately. If the packaging is damaged when you receive it, we recommend that you report this directly to the agent that delivered the package and contact us afterwards. If the damage is found first after opening the package you must notify us within seven (7) days.

Returning products

If you want to withdraw your order or make a reclamation contact us through [email protected] (see Contact Information).

Using our products and services

All content on the Site is intended for private knowledge or information needs. When you use our site and order products, you must always comply with all applicable laws, regulations and public orders. You may not use our services in a manner contrary to our, or any third party’s, rights and interests. You agree to comply with all instructions and recommendations provided by us.

You agree to be responsible for all activities that occur under your Account. You must keep your Account credentials secure at all times and you are forbidden to share details relating to your Account with any third party. If you suspect that your Account or your Account credentials have been or are being used by a third party you must contact us immediately at [email protected] (see Contact Information).

We reserve the right to decline or adjust an order from you and delete your Account if you provide us with untrue, not current, inaccurate, or incomplete information when creating your Account. This also applies if you fail to comply with these Terms and Conditions or other mandatory provisions by law.

All Products must be used in accordance with the instructions and precautions we have stated and communicated. It is your responsibility to make sure that the product does not contain anything you are allergic to. All Products on the Site are intended for personal use only.

Eligibility

To order products from our website, you must be 18 years of age or have a legal guardian’s approval. Your delivery address must also be in an area in which we have the possibility to deliver. At present, agreements can only be entered into with customers with a delivery address in Sweden. You also need to have a valid email address. We only offer the Products to consumers (as defined under applicable local law).

We reserve the right to refrain from entering into an agreement with you, without specifying the reasons behind the decision.

Your rights

PRIVACY

We process your personal data in accordance with our Privacy Policy.

Right of Withdrawal

We offer, in accordance with the Swedish Distance and Doorstep Sales Act (2005:59), the right to withdraw an order at any time before it is delivered and up to 30 days afterwards. You also have the right to withdraw a change in your Subscription. If you exercise your right of withdrawal regarding a change in the Subscription model, your Subscription will revert back to the latest model that you had before the change.

To exercise your right of withdrawal and cancel your order, you must clearly inform us preferably:

– by emailing us at [email protected]. , providing us with your order number and the email address used for your order.

This statement must be sent to us before the withdrawal period of thirty (30) days has expired.

Any Products that you wish a refund for must be returned by you. You must return the products to us within 30 days after the day of notifying us of the withdrawal, in the same condition in which you receive them. You have a legal obligation to take reasonable care of the Products while in your possession. If the product has been handled to a greater extent than was necessary to determine its properties or function, we will make a price deduction corresponding to the value of the item in question. Depreciation deductions can be made with up to 100% of the value of the item.

To return the products, you should package the parcel securely. Return shipping is paid for by you.

We will process any refund due to you within 14 days after the day on which we receive the returned products, provided that they are in unchanged condition. Refunds will be processed by using the same means of payment as you used for the initial transaction.

Reclamations

In accordance with the Consumer Purchase Act (1990: 932) you as a consumer have the right to make a complaint about a defective product. o exercise your right, you have to make the complaint within reasonable time (within two (2) months will always be considered as reasonable) from the point where you noticed or should have noticed the defect, by emailing us at hello@ha-bits.co. (see Contact Information). The right to make a complaint in relation to defects expires (3) three years after you have received the products or when the expiry date has passed.

In the event of defects, you may:

– Withhold payment until we have resolved the issue.
– Require a new delivery, meaning you will receive other equivalent Products.
Require a price reduction.
Terminate the agreement.

Delayed Products

If we have not delivered the Products within the period agreed between us, and this delay is not cause by you, you can:

– Withhold payment until the Products are received.
Demand a refund for the order.
Terminate the agreement.

OUR LIABILITY

Our responsibility towards you is regulated by the Swedish Consumer Purchase Act (1990: 932), the Distance and Doorstep Sales Act (2005:59) and the Product Liability Act (1992:18).

Warranty

We are liable for any defects existing at the time you receive the Products. We are not responsible for any defects caused by you, for example where you have not complied with maintenance instructions or if you have mistreated the Products.

Third party services

In some cases we rely on third party services and/or product providers. Such providers act beyond our reasonable control and we shall not be held liable for any damages caused by an action or omission attributable to them.

Force majeure

We are not liable for delays and defects occuring in the event of circumstances beyond our reasonable control (such as changes in legislation, government measures, strikes, blockades, sabotage, war, terrorism, fire, flood, natural disaster or similar events). If such events occur, we will inform you as soon as possible and try to minimize its consequences. By doing this, we will not be liable for defects and delays. If such a delay exceeds two (2) months, both you and vi have the right to terminate the agreement with immediate effect without any obligation to pay damages.

PROPERTY AND INTELLECTUAL PROPERTY RIGHTS

This Site is owned by HBTS Sweden AB. he Site and accompanied Products and Services may contain content specifically provided by us or our partners. Such content is protected by copyrights, trademarks, service marks, patents, trade secrets, logos or other proprietary rights and laws and is our property or a third party licensors’ property. You shall not sell, license, rent or otherwise use or exploit any Content for commercial use or in any way that violates any third party right without prior written consent. Using, reproducing, modifying, distributing or storing any Content for any purpose other than using the Services as provided by us and these Terms and Conditions is prohibited without prior written consent from us.

COMPLAINTS AND DISPUTES

We will always first try to solve your complaints through discussions between you and our Customer service. In the event of a complaint or dispute that we do not succeed in resolving together, we recommend that you contact The National Board for Consumer Disputes (ARN). We always follow their advice.

Please also note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform available at ec.europa.eu/consumers/odr.

GOVERNING LAW AND JURISDICTION

Swedish law applies to these Terms and Conditions and our legal relationship in general.
